Acceptance and eligibility
By accessing or using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old and legally able to enter into this agreement, or use the Service with the authorization of a parent or legal guardian where required. If you act for an organization, you represent that you may bind it to these Terms.
The Service
The features available through Koobit may change by product, device, operating system, region, version, or subscription level. We may add, modify, suspend, or remove features to improve the Service, protect users, comply with law, or address technical and business requirements.
Accounts and device security
Some features may require an account or sign-in through a third-party provider. You agree to provide accurate information, safeguard your credentials and device, and promptly notify us of suspected unauthorized access. You are responsible for activity through your account to the extent permitted by law.
Do not jailbreak, root, or otherwise compromise your device in a way that bypasses security protections or prevents the Service from functioning safely.
License and intellectual property
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.
The Service, software, design, content, trademarks, and related intellectual property belong to Koobit or its licensors. Except for the license above, no rights are transferred to you.
Acceptable use
You may not, and may not help another person to:
- copy, sell, rent, redistribute, translate, modify, or create derivative works from the Service except where law expressly permits;
- reverse engineer, decompile, extract source code, bypass security, or interfere with operation of the Service;
- use malware, automated scraping, bots, or unauthorized access methods;
- remove proprietary notices or claim ownership of our intellectual property;
- infringe another person’s rights, violate law, or use the Service for fraud, abuse, or other harmful activity.
Purchases, subscriptions, and trials
The Service may offer one-time purchases, subscriptions, or free trials. Prices, billing periods, included features, and trial terms are shown before purchase. Subscriptions may renew automatically unless canceled before the end of the current billing or trial period.
Purchases are processed by the applicable platform or payment provider. You must manage cancellation through that provider and remain subject to its payment and refund rules. Except where law or the provider’s policy requires otherwise, access continues until the end of the paid period and partial-period refunds are not guaranteed.
Third-party services and advertising
The Service may contain third-party SDKs, content, links, sign-in tools, analytics, payment services, or advertising. Third parties operate under their own terms and privacy policies. We do not control and are not responsible for third-party services, content, availability, or acts, except where applicable law provides otherwise.
Connectivity, compatibility, and updates
Some functions require an internet connection, a compatible device, sufficient battery and storage, or an up-to-date operating system. You are responsible for carrier charges, data fees, roaming charges, device maintenance, and permission from the device or account owner where applicable.
We may release updates, including automatic updates. Continued use may require installing them. We do not promise that every version will remain compatible with every device or operating system indefinitely.
Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, or freedom from errors and harmful code. Your use is at your own risk.
Limitation of liability
To the maximum extent permitted by law, Koobit, its affiliates, and their personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, business, opportunity, or goodwill arising from the Service. Nothing in these Terms excludes rights or liability that cannot legally be excluded or limited.
Indemnity
To the extent permitted by law, you agree to defend and indemnify Koobitand its affiliates against claims, losses, and reasonable costs arising from your unlawful use of the Service, violation of these Terms, or infringement of another person’s rights.
Suspension and termination
You may end this agreement by stopping use of the Service. We may suspend or terminate access, or discontinue the Service, when reasonably necessary, including for violations, security risks, legal requirements, or discontinuation of a product. Upon termination, your license ends. Provisions that by nature should survive will remain in effect.
Changes to these Terms
We may revise these Terms from time to time. Updated Terms take effect when posted, as shown by the effective date. Where required, we will provide additional notice of material changes. Continued use after the effective date constitutes acceptance where permitted by law.
General terms and contact
These Terms and the Privacy Policy form the agreement between you and us concerning the Service. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a right is not a waiver. You may not transfer your rights without our consent; we may transfer ours as part of a reorganization or business transaction. Applicable law and competent courts will govern disputes, subject to mandatory consumer protections.
